美国对华8年维C反垄断终审 华药被判9亿天价赔款

color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">“在3月陪审团意见的基础上，法院最终维持了支持原告的裁决，裁决损害金额5410万美元，”昨日，长期关注该案件的一位权威人士向本报透露，“根据美国法律，这笔损害金额将按3倍赔偿计算，赔偿额度为1.62亿美元，冲减之前已经和解的900万美元，维尔康最终赔偿金额应为1.53亿美元。”</p><p style="margin-top: 26px; margin-bottom: 26px; text-indent: 2em; color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">4天后的商务部例行发布会上，中国商务部新闻发言人沈丹阳就此案曾公开表态称，美国联邦地区法院在“维生素C反垄断案”中对中国企业的审理结果是不公正和不恰当的，美国法院基于中国企业在中国的合法行为而对其处以巨额的惩罚性赔偿，是完全不合适的。</p><p style="margin-top: 26px; margin-bottom: 26px; text-indent: 2em; color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">“美国法院陪审团的裁决属于一审裁决，是有悖事实的非公正判决，作为中国制药企业将坚持抗拒美国的贸易保护主义，坚决依法维护正当权益。”华北制药公关经理孟蕾接受本报采访时曾表示，“华北制药和维尔康公司将启动上诉程序。”</p><p style="margin-top: 26px; margin-bottom: 26px; text-indent: 2em; color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">由于产能严重过剩，各生产企业竞争惨烈，持续多年价格战之下，各生产企业都在半开工或部分停工状态，产业发展极度失衡。<br><br></p><p style="margin-top: 26px; margin-bottom: 26px; text-indent: 2em; color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">“在美国市场上，华北制药是老牌的供应商，因为出口时间早，国际认证多，渠道和客户比较稳定，”该专家表示，“但这几年包括江山制药、石药等其他企业起来得很快，华北制药的优势并不是最突出的。”</p><p style="margin-top: 26px; margin-bottom: 26px; text-indent: 2em; color: rgb(37, 37, 37); font-family: 宋体, sans-serif; line-height: 24px; text-align: justify;">上述专家判断，华北制药的败诉将会让出其美国市场原有的份额，短期内不仅会使其他几家中国企业受益，也会拉动维C的出口价格。</p><p style="margin-top: 26px;
